Please read these Terms carefully before using our website or purchasing our products. By visiting our website, creating an account, placing an order, enrolling in a subscription, or otherwise using our services, you agree to be bound by these Terms and any policies referenced in them, including our Privacy Policy, Shipping Policy, and Return Policy.

We reserve the right to refuse service, cancel orders, terminate accounts, or restrict access to the website for any reason permitted by law.

3. Our Products

Born Stubborn.™ sells dog wellness products, including supplements, chews, balms, wipes, and related pet wellness products.

Our products are intended for dogs only unless expressly stated otherwise on the product label or product page. You agree to use our products only as directed and to read all product labels, warnings, and instructions before use.

Our products are not intended for human consumption.

4. No Veterinary or Medical Advice

It is not veterinary advice, medical advice, diagnosis, treatment, or a substitute for professional guidance from a licensed veterinarian.

You should consult your veterinarian before using any Born Stubborn.™ product, especially if your dog is pregnant, nursing, elderly, very young, taking medication, has a diagnosed medical condition, has a history of allergies or sensitivities, or is scheduled for surgery.

If your dog experiences any unwanted reaction, stop using the product and contact your veterinarian.

5. FDA Disclaimer

Statements made about our products have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

Individual results may vary. We do not guarantee that any product will produce a particular result for your dog.

6. Product Information, Ingredients, and Availability

We make reasonable efforts to provide accurate product descriptions, ingredient information, images, pricing, and availability. However, we do not guarantee that all information on the website is complete, current, accurate, or error-free.

Product packaging, formulas, specifications, images, labels, and availability may change from time to time. The product you receive may vary slightly from images or descriptions shown online.

We reserve the right to modify, discontinue, reformulate, or limit the availability of any product at any time without notice, subject to applicable law.

7. Orders and Acceptance

When you place an order, you are making an offer to purchase the products in your cart. We reserve the right to accept, reject, cancel, or limit any order for any reason permitted by law.

We may cancel or limit orders that appear to be fraudulent, suspicious, inaccurate, placed by resellers, placed in violation of these Terms, or otherwise unsuitable for fulfillment.

If we cancel an order after payment has been processed, we will issue a refund for the canceled portion of the order.

8. Pricing and Payment

Prices are listed in U.S. dollars unless otherwise stated. Prices, promotions, discounts, and product availability may change at any time without notice.

We currently accept payment through the payment methods made available at checkout, including Shop Pay and card payments processed through our payment providers.

You agree to provide current, complete, and accurate billing, shipping, and account information. You authorize us and our payment processors to charge your selected payment method for your order, including applicable taxes, shipping, and other charges shown at checkout.

9. Subscriptions

Some products may be available through an optional subscription plan. If you enroll in a subscription, you authorize us to charge your selected payment method on a recurring basis according to the subscription frequency and terms shown at checkout.

Subscription charges continue until you cancel. Subscription pricing, product availability, and delivery frequency may vary depending on the subscription option selected.

We are not trying to hide recurring charges or make cancellation difficult. You may cancel your subscription at any time by emailing us at info@bornstubborn.co with your cancellation request. If a customer portal is available, you may also be able to manage or cancel your subscription through that portal.

Cancellation must be received before the next order is processed and shipped. If your subscription order has already been processed or shipped before your cancellation request is received, that shipment may still go out and be charged, but your subscription will be canceled going forward.

If your payment method fails, we or our subscription provider may attempt to process the payment again and may contact you to update your payment information.

10. Shipping and Fulfillment

Born Stubborn.™ currently ships only within the United States.

Orders may be fulfilled by third-party fulfillment partners. Shipping times shown on the website or at checkout are estimates only and are not guaranteed. While we make reasonable efforts to process and ship orders promptly, delays may occur due to carrier issues, fulfillment delays, weather, holidays, inventory availability, address errors, or other circumstances outside our control.

We are not responsible for delays caused by carriers, fulfillment partners, incorrect shipping information, or events beyond our reasonable control.

11. 30-Day Money-Back Guarantee

Your dog gets 30 days to decide.

If a Born Stubborn.™ product is not a fit, contact us within 30 days of delivery at info@bornstubborn.co and we will refund your purchase. You do not need to return the product unless we specifically ask you to do so.

We reserve the right to refuse or limit refunds if we believe the guarantee is being abused, including repeated refund requests, excessive quantities, suspected reseller activity, fraud, or other misuse.

Shipping charges, if any, may not be refundable unless required by law or unless we choose otherwise.

12. Personal Use Only and No Resale

Born Stubborn.™ products are sold for personal use only. You may not purchase our products for resale, redistribution, or commercial sale without our prior written permission.

Unauthorized resale is prohibited. We reserve the right to cancel or refuse orders that we believe are placed by resellers, distributors, marketplace sellers, or anyone purchasing products for commercial resale.

Purchasing Born Stubborn.™ products from unauthorized sellers may create risks related to product authenticity, storage, handling, freshness, and safety. We are not responsible for products purchased from unauthorized sellers.

13. Promotional Codes and Discounts

Promotional codes, coupons, discounts, and special offers are subject to the terms shown at the time of the offer. Unless otherwise stated, promotional offers have no cash value, cannot be combined with other offers, may be limited to one use per customer or household, and may be modified or canceled at any time.

We reserve the right to reject, cancel, or revoke any promotion, discount, or code that is used incorrectly, fraudulently, or in violation of the applicable offer terms.

By providing your email address, you may receive transactional emails related to your orders, account, subscription, shipping, customer support, or other service-related matters.

By submitting content to us, you grant Born Stubborn.™ a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, modify, publish, display, distribute, and create derivative works from that content in connection with our business, marketing, advertising, social media, website, and product promotion.

We may edit submissions for length, clarity, formatting, grammar, or compliance, but we are not obligated to use, publish, maintain, or respond to any submission.

You agree not to submit content that is false, misleading, defamatory, obscene, abusive, unlawful, infringing, invasive of privacy, or otherwise objectionable.

Testimonials and reviews reflect individual experiences and do not guarantee that other customers or dogs will have the same experience.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms, the website, or any product purchased from us will not exceed the greater of: (a) the amount you paid to us for the product giving rise to the claim, or (b) USD $100.

Nothing in these Terms limits liability where such limitation is prohibited by law.

You agree to defend, indemnify, and hold harmless Born Stubborn.™, Oakwyn Collective LLC, and their owners, officers, directors, employees, contractors, affiliates, suppliers, service providers, fulfillment partners, licensors, and agents from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

(a) your breach of these Terms;
(b) your misuse of the website or products;
(c) your violation of any law or the rights of a third party;
(d) your user content or submissions; or
(e) your unauthorized resale or distribution of our products.

24. Dispute Resolution, Arbitration, and Class Action Waiver

You and Born Stubborn.™ agree that any dispute, claim, or controversy arising out of or relating to these Terms, the website, any product, any order, any subscription, any communication, or the relationship between you and us will be resolved through final and binding individual arbitration, rather than in court, except as stated below.

The arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules, unless the parties agree otherwise. The arbitration will be conducted in Wyoming, unless the parties agree to conduct the arbitration by telephone, video conference, written submissions, or another location.

These Terms and any dispute between you and us will be governed by the laws of the State of Wyoming, without regard to conflict of law principles, and by the Federal Arbitration Act where applicable.

Before starting arbitration, the party bringing a claim must first send written notice describing the dispute and the requested relief. Notices to Born Stubborn.™ should be sent to info@bornstubborn.co. The parties agree to try in good faith to resolve the dispute informally for at least 30 days after notice is received.

You and Born Stubborn.™ agree that each may bring claims only in an individual capacity and not as a plaintiff, class member, or representative in any class action, collective action, private attorney general action, or other representative proceeding.

The arbitrator may not consolidate claims of different customers or users and may not preside over any form of class or representative proceeding.

You and Born Stubborn.™ each waive the right to a jury trial and the right to participate in a class action.

Either party may bring an individual claim in small claims court if the claim qualifies and remains in small claims court. Born Stubborn.™ may also seek injunctive or equitable relief in court to protect its intellectual property, confidential information, brand, website, or products.

If any part of this arbitration or class action waiver section is found unenforceable, the remaining portions will remain in effect to the fullest extent permitted by law.

25. Governing Law

These Terms and any separate agreements between you and Born Stubborn.™ are governed by the laws of the State of Wyoming, without regard to conflict of law principles.

Subject to the arbitration section above, you agree that any legal action not subject to arbitration will be brought only in the state or federal courts located in Wyoming, and you consent to the jurisdiction and venue of those courts.

26. Termination

These Terms remain in effect unless terminated by either you or us. You may stop using the website at any time.

We may suspend or terminate your access to the website, cancel orders, terminate accounts, or refuse service if we believe you have violated these Terms, engaged in fraud or abuse, or used the website or our products in a way that may harm us, our customers, our partners, or any third party.

Sections that by their nature should survive termination will survive, including intellectual property, user content, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and any payment obligations.
